Terms and Conditions

The following terms and conditions of contract apply from the date of booking between ‘The Client’ and The Wilmington Hotel Limited trading as the New Wilmington Hotel. Online booking by the Client implies acceptance of these terms and conditions. In these terms and conditions, the expression ‘The client’ means the person, firms or company booking the accommodation at the Hotel.

  1. Payment

Accepted payments are by credit/debit cards or bank transfer.  Due to current health & safety measures, our hotel practice is for minimal contact with our guests.  We require full payment for your accommodation on or prior to arrival so we can check you in quickly whilst adhering to social distancing.

Any query concerning the agreement or the charges made shall not affect the Client’s obligation to pay all outstanding balances immediately.

  1. Cancellations & Non – arrival Charges

Should you wish to cancel or amend your reservation we would request that you contact us as soon as possible to make arrangements. In the event of a cancellation within the non-refundable period and should we be unable to re-let your room, a cancellation charge will be made for the accommodation rate purchased.  Non-arrivals will be charged the full amount for their stay.

Flex Rate – Free cancelation up to 24-hours prior to arrival.  Credit card required to secure your booking.  Full payment for your stay will be taken within 24 hours of your arrival.

Book Now Rate – Non-refundable booking rate. 50% deposit is required to secure your booking. 50% will be taken within 24 hours of arrival.

Advance Rate – Non-refundable special rate for all bookings over 30-days prior to arrival.  50% deposit required at time of booking.  50% payment taken 30-days prior to arrival.

We regret that no allowance can be made for meals not taken or for any temporary absence from the Hotel.

  1. Licensing and Statutory Regulations

The Hotel is subject to Statutory Regulations including those relating fire precautions and entertainment. The regulations must be strictly observed, and a copy is available from the Hotel. The provisions of the Licensing Act 1964 as amended must also be observed.

  1. Third Party Injury Insurance

The Hotel accepts no responsibility for the death, bodily injury or disease arising from any cause whatsoever to: a) Persons visiting the Hotel and/or the allocated rooms on behalf of, at the invitation of, or at the request of the Client, whether such death injury or disease occurs within the allocated rooms or in any other part of the Hotel.
b) Person employed by the Client during the period of hire, whether such death, injury or disease occurs within the allocated rooms or in any part of the Hotel. Except for legal liability arising due to negligence of the Hotel, its employees, servants, representatives or agents.

  1. Personal Property

The Hotel accepts no responsibility for loss or damage to the property of Clients or guests. The hotel does have a safe in reception on request but at the hotel’s discretion. Any property deposited in safes is strictly at the owners risk except for legal liability arising due to negligence of the Hotel, its employees, servants, representatives, or agents.

  1. General Liability

The Hotel will not be liable for any failure to provide the services contracted in the following circumstances.
1. industrial action by the hotel’s employees
2. industrial action by the staff of a major supplier
3. fire, lightning, aircraft impact, explosion, riot and civil commotion, malicious damage, storm, tempest, flood, burst pipes, earthquake and impact
4. breakdown of plant, or any failure to supply the Hotel with gas, electricity, water services etc
Without prejudice to the foregoing and without inferring any liability against them, the Hotel undertakes to take all possible action to alleviate any such inconvenience.
This contract shall not be assignable. This contract shall be governed by, and construed in all respects, in accordance with the law of the country in which the Hotel for which the booking is made and is situated and the Clients submits to the exclusive jurisdiction to the courts of such country.

  1. Damage

The Client shall be responsible for any damage caused to the allocated space or the furnishing, utensils and equipment therein by any act, default or neglect of the Client including by any sub-contractor or guest of the Client and shall pay to the Hotel on demand the amount required to make good or remedy any such damage.

  1. Advertising

Clients wishing to print details of the Hotel or its telephone number in any publication or advertisements must obtain written permission from the Hotel prior to doing so.

  1. Hotel Proprietors Act 1996

This agreement does not affect any rights, which the Client may have under the Hotel Proprietors Act 1956 where the act applies.

  1. Insurance

No responsibility whatsoever is accepted in respect of theft, injury or disease to clients or visitors, nor for loss or damage to property of any kind; less arising as a legal liability for negligence by the hotel, or employees, or representative or agents. Clients should arrange their own insurance for the period of their stay at the hotel.

  1. Virus, Disease and Pandemic

The hotel does not cover loss, destruction or damage, or any costs or expenses of whatsoever nature directly or indirectly occasioned by, arising from, caused by, happening through or in consequence of, or otherwise attributable to:

  1. Coronaviruses
  2. Coronavirus disease (COVID-19)
  3. Severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)
  4. Any mutation of or variation of 1), 2) or 3) above
  5. any infectious disease that is designated or treated as a pandemic by the World Health Organisation
  6. Any fear or anticipation of 1), 2), 3), 4) or 5) above.

In the event of the hotel being forced to close by the UK Government any bookings made within this period with deposit payments taken will be offered as a credit to re-book at a future date.

Client’s statutory rights are not affected.

12. Security

New Wilmington Hotel reserves the right to carry out security searches upon entry to the hotel and to refuse entry to any member of the public visiting or resident at the hotel.

The hotel reserves the right to require a valid ID at check-in.  Under 18’s are not allowed to check-in and will be charged as a cancellation if unable to provide sufficient ID to confirm.
